Commercial Litigation

Our firm conducts a wide range of commercial litigation including disputes in the:

  • ACT Supreme Court
  • ACT Magistrates Court
  • ACAT (ACT Civil and Administrative Tribunal)
  • New South Wales Local, District and Supreme Courts
  • Federal Court and Federal Magistrates Court of Australia

The ACAT is a newly formed Tribunal which now covers the jurisdiction of the former Small Claims Court and is a “no costs forum” for small claims. As a service to our business clients, we provide a debt collection service and have been able to operate within the jurisdictional confines of ACAT effectively in recovering debts of up to $10,000.00.

Debts above $10,000.00 and up to $250,000.00 require litigation to be instigated in the ACT Magistrates Court. Anything over $250,000.00 must be commenced in the Supreme Court. These two Courts have a recoverable costs component and in the normal cause, costs usually follow the outcome.

We can provide specific services in the following areas:

  • Commercial and Business disputes
  • Debt collection
  • Building contracts and dispute resolution
  • Bankruptcy and insolvency
  • Contractual disputes

In all jurisdictions we are particularly mindful of achieving a commercial and favourable outcome for our clients, however that is not always possible. As such we ask that all clients are mindful of their means and on our part we endeavour to ensure the cost of the litigation itself does not exceed the debt.
